Our approach
Photos on EarthyMuse are shared by the people who took them, and our guidelines forbid posting anyone else's. If one slips through, we want to know. We respond to notices under the Digital Millennium Copyright Act (DMCA).

Reporting something that infringes your copyright
Your notice must include:
- —a description of the copyrighted work you believe was infringed;
- —the link to the page on EarthyMuse where the material appears, specific enough for us to find it;
- —your name, postal address, phone number and email address;
- —a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law;
- —a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them;
- —your physical or electronic signature (a typed full name is fine).
When we receive a complete notice, we remove or disable the material promptly and let the person who posted it know, with a copy of the notice.
If your photo was removed by mistake
If you believe your material was removed because of a mistake or misidentification, you can send a counter-notice to the agent above. It must include:
- —a description of what was removed and where it appeared before removal;
- —your name, postal address, phone number and email address;
- —a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification;
- —a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the US, any judicial district where we can be found), and that you will accept service of process from the person who sent the original notice;
- —your physical or electronic signature.
We forward a complete counter-notice to the person who complained. Unless they tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
Repeat infringers
We keep a record of valid notices. When an account receives repeated valid notices, we close it and remove what it has posted.
Please be accurate
Under the DMCA, anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages. If you are unsure whether something infringes your rights, consider asking a lawyer first.
