Who we are
EarthyMuse is run by [Your full legal name], a sole proprietor doing business as EarthyMuse in Santa Clara County, California. “We” and “us” below mean EarthyMuse. By using the site you agree to these terms. If you do not agree, please do not use it.
Who can use EarthyMuse
You must be at least 18 years old to use EarthyMuse, create an account or share anything. By using the site, you confirm that you are. The site is intended for people in the United States.
Your account
Keep your password to yourself. You are responsible for what happens under your account. Tell us at [hello@yourdomain.com] if you think someone else is using it.
We do not sell anything, and we earn from links
EarthyMuse helps you find and compare products. We do not sell them. When you click through to a retailer or brand, you buy from them, under their terms, and they handle payment, shipping, returns and warranties.
Some links on EarthyMuse are affiliate links. If you buy something after clicking one, we may earn a commission, at no extra cost to you. That never decides whether a product is listed or how it is described.
Prices, availability and product details belong to the retailer and can change at any time. Always check the retailer's page before you buy.
Sustainability information
Product claims, like “organic” or “plastic-free”, come from the product's own listing, and we show the phrase they were found in. Products a brand lists itself carry tags reported by that brand, which we check before listing and label as such. We have not independently tested or certified the products. Our label glossary explains what certifications mean, but check with the brand or the certifier if a claim matters to you.
The AI assistant
The assistant suggests products from our catalogue using an AI model. It can be wrong or incomplete. Treat its answers as a starting point, not advice, and do not type personal or sensitive information into it.
Photos and stories you share
You keep ownership of what you share. By submitting a photo, caption or story, you give us a non-exclusive, royalty-free, worldwide permission to store it, make technical copies of it (for example resizing, converting its format, and backups), and show it on EarthyMuse next to the product or topic it is about. Nothing else: we do not sell it, license it to anyone, or use it in advertising.
That permission ends when you delete your submission or ask us to, except for copies in backups that expire on their own, and anything we are required by law to keep.
When you share something, you promise that:
- —you took the photo or wrote the words yourself;
- —anyone recognisable in it has agreed to be shown, and for a child, their parent or guardian has;
- —it is honest about your own experience, and you are not being paid or given free products by the brand without saying so.
Brand accounts
Brands can apply for an account to list their own products. By applying, you confirm you are authorised to act for that brand. We check every application and every product before it goes live, and we may decline either.
When you list a product, you promise that:
- —its description, price and sustainability tags are accurate, and you can back up every environmental claim you make;
- —any certification you select is current, and the proof you give is genuine;
- —you own the product photos, or have permission to use them.
You give us a non-exclusive, royalty-free, worldwide permission to show your product listings, photos and brand name on EarthyMuse, and to resize and format them for the site, for as long as the product is listed. We label your tags as reported by your brand. We may remove a listing, or close a brand account, if a claim turns out to be inaccurate or these terms are broken.
How we moderate
Submissions are checked against our photo guidelines, before or after they appear. We remove things that break those rules. We never remove a review because it is negative or unflattering to a brand.
We may remove content, or suspend or close accounts, that break these terms or the guidelines, or that we are legally required to remove. Illegal content, including anything that sexually exploits a child, is reported to the authorities.
Copyright
If you believe something on EarthyMuse infringes your copyright, follow the steps on our Copyright & DMCA page. We close the accounts of people who repeatedly infringe.
Things you must not do
- —break the law, or help anyone else to;
- —scrape, copy or republish the site or its content in bulk, or use bots to access it, other than search engines indexing public pages;
- —try to get around rate limits, moderation or security, or interfere with how the site works;
- —impersonate anyone, or post spam, promotions or referral links.
Our content
The site's design, guides, graphics and writing belong to us or the people who licensed them to us. You are welcome to read them and share links. Please do not copy them wholesale.
No guarantees
EarthyMuse is provided “as is”. We work to keep it accurate and available, but we do not promise that it will be error-free, uninterrupted, or that any product will suit you. To the extent the law allows, we disclaim all implied warranties.
Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for anything to do with a product you buy from a retailer. Our total liability to you for any claim is limited to $100. Some places do not allow these limits, so they may not all apply to you.
If you break these terms and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim.
Changes and ending
We may update these terms. If a change is significant, we will say so on the site before it takes effect, and the date at the top will change. You can stop using EarthyMuse at any time, and we may stop offering it.
Law and disputes
These terms are governed by the laws of California. Any dispute will be handled in the state or federal courts located in Santa Clara County, California, unless the law where you live says otherwise. Please contact us first, since most problems are easier to fix by email.
